In an urgent petition, the US Department of Justice urged the judiciary to set aside a earlier court order that had blocked the sending of a few hundred military reserve personnel to the Chicago area.

The presiding judge had expressed skepticism about the government's reasoning for deploying forces, questioning its reasoning in given regional circumstances.

A higher court affirmed the previous order on Thursday, maintaining the stationing on standby while the judicial dispute proceeds.

Administration's Arguments

The solicitor general, speaking on behalf of the administration, stated in the recent request that government officers have frequently been “threatened and attacked” in Chicago and the suburb of Broadview community.

The president has already sent state guard units to Chicago, Illinois and Portland, after earlier deployments to Los Angeles, the city of Memphis, and Washington, District of Columbia.

At the core of the dispute is the president’s use of a US code authorizing the commander-in-chief to nationalize the military reserve only in cases of uprising or when “unable with the federal troops to carry out the regulations of the nation”.

The White House argues that the personnel are required to safeguard federal property and agents from activists.

Previously, the White House nationalized three hundred members of the state guard of Illinois and commanded more Texas national guard personnel into the Illinois.

As state authorities criticized the move, the White House intensified his language, demanding the apprehension of Chicago’s mayor and the state's chief executive, both Democrats, accusing them of neglecting to safeguard ICE personnel.

State authorities and municipal government jointly sued the White House to block the activation.
